Getting Restraining Order Seek Help Domestic Violence Attorney

On Behalf of Law Offices of Daniele Johnson, LLC | Jul 24, 2020 | Firm News

When someone hurts you, whether that’s through physical or verbal abuse, you may want to get a restraining order against them. This legal document forces the person to stay away from you so they can’t hurt you again. If they violate this order, there will be serious consequences in court. Wondering if you need one or how to get one? Read on and then contact our domestic violence attorney – we’ve got the information you’re looking for.

When to Get a Restraining Order

Anytime someone abuses you, you can get a restraining order against them. Common episodes of abuse include:

  • Assault
  • Burglary
  • Sexual assault
  • Harassment
  • Kidnapping
  • Stalking

There are many other reasons to file a restraining order. Talk to a domestic violence attorney to see if your situation qualifies.

How to Get a Restraining Order with a Domestic Violence Attorney

The first step is to visit your local courthouse and file a petition or request for a temporary protection order. You will be asked to fill out forms with your contact information, as well as that of your abuser. It’s okay if you don’t know everything, but try to provide as much information as you can. You will also be asked to provide a description of the abuse and any proof you may have. This can be pictures of injuries, or printed copies of emails, texts, or social media messages.

The judge will review the information and set a date for a court hearing. If he or she feels you are in immediate danger, they will likely grant a temporary protection order. This will protect you from the abuser until you can have the official court hearing.

At the hearing, your abuser will be invited and the judge hear both sides of the case. If the judge appeals to your side, you will receive more permanent protection, typically a restraining order.

Signs You Need a Domestic Violence Attorney

If your hearing is successful, you will receive a permanent restraining order. This order will detail the specifics about what your abuser can and can’t do. It’s important to ask the judge or your domestic violence attorney if you have any questions about what’s contained in the order. To make things easier, keep a copy of the order with you at all times. That way, if anything happens, you can call the police and show them the order to help them understand your situation better.

If your abuser violates the restraining order, you have legal rights. Depending on the situation, you may wish to call the police, the court, or a domestic violence attorney. These people will be able to protect you and properly punish your abuser.
